These Terms and Conditions (“T&Cs”) govern your access to and use of the Quad Properties website (the “Site”). By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these T&Cs and our separate Privacy Policy. If you do not agree to all of these T&C’s, you are expressly prohibited from using the Site and must discontinue use immediately.

I. General Terms and Agreement

  • Agreement and Acceptance
    By accessing and using the Site, you agree to be bound by these entire terms and conditions and our Privacy Policy, each of which is incorporated by reference herein.
  • EligibilityThe site is intended for users who are at least eighteen (18years old. By using the Site, you represent and warrant that you are of legal age and capacity to enter into this binding agreement with Quad Properties.
  • Modifications
    We reserve the right, at our sole discretion, to change or modify these T&Cs at any time. We will notify you of any material changes by posting the updated T&C’s on the Site and updating the “Last Updated” date. Your continued use of the Site after such changes constitutes your acceptance of the new Terms.

II. Intellectual Property Rights (IP)

  • Ownership
    Unless otherwise indicated, the Site is our proprietary property. All source code, database, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the Trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us are protected by copyright and trademark laws.
  • Limited License and Use Restriction
    The Content and Marks are provided on the Site “AS IS” for your information and personal, non-commercial use only. You may not copy, reproduce, aggregate, republish, upload, post, publicly display, encode, translate, transmit, distribute, sell, license, or otherwise exploit any part of the Site, Content, or Marks for any commercial purpose whatsoever, without our express prior written permission.

III. Retal Application, Screening and Fees

This section governs the use of the Site’s application features and the Applicant’s responsibilities and consents.
  • The Role of Quad Properties
    You acknowledge that the Site’s role is strictly limited to that of a technology platform for displaying listings and facilitating application data collection.
  • Application Submission and Accuracy
    • Warranted Accuracy: By submitting a rental application (the “Application”), the Applicant warrants that all information provided is true, accurate, and complete to the best of their knowledge.
    • Consequence of Misrepresentation: The Applicant agrees that any false, misleading, or incomplete information is grounds for immediate disqualification at the sole discretion of the Property Owner/Manager (the “Landlord/Agent”) and constitutes a material breach of these T&Cs.
  • Required Consent and Authorizations
    By submitting an Application, you grant the following explicit, continuing authorizations:
    • Credit and Background Check Consent: You explicitly authorize the Landlord/Agent and/or their third-party screening providers to obtain consumer reports, credit reports, criminal background checks, eviction history, and reference checks from any relevant reporting agency (including Equifax, TransUnion, Experian, and landlord credit bureaus).
    • Scope: This authorization is granted for the purpose of verifying information and assessing your current and ongoing eligibility for tenancy.
    • Contact Authorization: You consent to be contacted by Quad Properties or the Landlord/Agent regarding your Application.
  • Application Fees and Deposits
    • Non-refundable Fee: Any application or screening fees are non-refundable, regardless of whether the application is approved, denied, or withdrawn, unless prohibited by applicable local law.
    • Holding Deposits: The terms governing any separate holding deposit will be communicated by the Landlord/Agent and must comply with applicable law governing the state.

IV. Disclaimers and Limitation of Liability

  • Disclaimers of Warranties
    The Site and all content, materials, information, and services provided are offered on an “AS IS” and “AS AVAILABLE” basis. Quad Properties expressly disclaims all warranties, express or implied, including, buit not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no guarantee regarding the accuracy, safety, legality, or equality of any property listings, application results, or user content.
  • Limitation of Liability
    IN NO EVENT WILL Quad PROPERTIES OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR THE ANY DIRECT, INDIRET, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site, even if we have been advised of the possibility of such damages.

V. Governing Legal Clause

  • Indemnification
    You agree to defend, indemnify, and hold harmless Quad Properties, its officers, directors, and agents, from and against any and all claims, damages, obligations, losses, liabilities, cost, or debt arising from: (i) your use if and access to the Site; (ii) any violation of any these T&Cs; or (iii) any claims arising from your interaction with any third-party service providers, property owners, or managers encountered through the Site, including but nit limited to any potential or actual rental agreement.
  • Links to Third-party Sites
    The Site may contain links to third-party services (e.g., external application forms, utility websites). We are not responsible for the content or T&Cs of any external websites.
  • Governing Laws and Jurisdiction These T7Cs and your use of the Site are governed by and construed in accordance with the laws of State of North Carolina, without regard to its conflict of law principles. Any legal action or proceeding related to the Site shall be brought exclusively in the courts located in North Carolina.
